re: renting the cam - you will/should have a document that you rented the camera on a certain day, and it will most likely show the time period that you rented it [certainly, no one will rent a camera without any proof that it was rented by Mr. X on Y date at Z time]. since the exif of the photo will show that it was taken while you were renting the cam, then that will be proof that you took the picture. also, the the time stamp when you downloaded the photo to your pc/mac would be additional proof.

re: borrowing - still the same with the time stamp when you downloaded the photo to your pc/mac. this would result in the strong assumption that you took the photo, as obviously, both of you could not have downloaded the photo to your respective pcs/macs at the same time.

I don't know about the other brands but Canon allows you to input your name + your copyright notice onto the camera firmware, and this will be included in the exif data. of course, exif data can be altered, but it's better than nothing.

that's a common problem among filipino photographers. however, things are slowly changing. for example, i know a multi-awarded photog who will be taking legal actions regarding a large establishment in the city for using his photograph without consent, a photo journ has also taken action against a vendor who printed his images on t-shirts. a manila photo has also taken action against a major broadsheet.

while it is unfortunate that we'd have to go the extra mile to pursue our rights, we have to show these people that we are fully aware of our rights

since your question refers to a newspaper, you write and complain your photo was used without your consent, and demand that you be acknowledged as the photographer. i'm not so sure if you can demand compensation for the use of the photo, because that could fall under the concept of "fair use", depending on the circumstances of the case.

I second the motion your point of view but not taking seriously this "monthly contest" would just be like moving forward one step and moving backward two steps..even though there's no monetary gain in the said contest, this is a good venue to learn NOT only from the criticism of the images we took as well as from the other photogs but also to be enlightened from the laws that may affect photography as a whole... if we pursue the monthly contest without addressing the "copyright" issue being raised by a few concerned photogs then one of these days another istoryan will raise this issue and it would be looping, redundant.... it's better to address this now and move on for a smooth sailing...and hopefully I can still see familiar names willing to tackle, discuss and address whatever issue(s) that will be raised by anyone of us in the future...

now, for my dummy question.... for example there's a watermark in the picture, how can you remove this? or can this be removed using any software? because it will be done then forget what I said, let's move on and vote who would facilitate the next monthly contest...

    I nominate radiostar, any takers?
