THE University of the Philippines Law Center yesterday said the P503 million North Railways contract with China is "flawed and illegal".
Prof. Merlin Magalona and lawyer Harry Roque said the contract to rehabilitate 32 kilometers of railways from Caloocan City to Malolos, Bulacan, by the China National Machinery and Equipment Corp. (CNMEC) runs against the provisions of the Constitution.
The study was presented to senators during yesterday’s hearing at the Senate convening as a committee of the whole.
Rene Santiago, a technical expert of the center, said the contract was void and illegal since it was awarded to the CNMEC without public bidding.
Santiago said the project was not supported by a bill of quantities, which refers to the statement of work, material, labor, and specifications of the rolling stock.
Under an agreement signed in December 2003, China’s Export-Import Bank would bankroll the project with a $400 million loan and the Philippine government would put up a counterpart fund of $103 million.
The contract was one of the cases that pro-impeachment legislators had planned to present at the impeachment trial of President Arroyo.
Bartolome Fernandez, former commissioner of the Commission on Audit during the Aquino administration, said the contract did not include a certification of availability of funds.
He said such certification should be attached as an integral part of the proposed contract entered into by the government.
Fernandez said that of the $503 million project cost, $100 million would be shouldered by the Philippine government.
However, he noted that there is no appropriation in the national budget to finance the project.
"Without (the certification), (the contract) is void," he said.

FOR attending yesterday’s Senate inquiry on the North Railways project, a government corporate lawyer found himself locked out of his office.
Efren Gonzales, assistant government corporate counsel, is the third person to taste the wrath of Executive Order 464 which prohibits the appearance of senior officials before legislative inquiries without the permission of President Arroyo.
The order to padlock Gonzales’ office came from government corporate counsel Agnes Devanadera.
Gonzales was the lone government official who showed up to testify on the P503 million project which has been described by a UP Law Center study as illegal, flawed and violative of accounting and auditing laws.
Other scheduled resource persons stayed away, claiming that they either had not yet looked over the UP Law Center study on the project or because of EO 464.
Aside from Gonzales, the other resource persons invited to the hearing were Northrail president Jose Cortes Jr., Bases Conversion Development Authority (BCDA) president Narcisco Abaya, Budget Secretary Romulo Neri, former Finance Secretary Juanita Amatong, Transportation Secretary Leandro Mendoza; presidential legal counsel Merceditas Gutierrez, Philippine National Railways general manager Jose Sarolla II, Transportation Undersecretary Guiling Mamondiong, MRT-3 general manager Roberto Lastimoso and LRT manager Melquides Robles.
Senate President Franklin Drilon said he was informed by Executive Secretary Eduardo Ermita that the officials failed to secure Arroyo’s permission.
"I got a text (message) from my wife and my secretary, informing me that my office had been padlocked," Gonzales told the committee.
Gonzales said he did not get the consent of the President before going to the hearing because he believes that he is not covered by the executive order.
"Hindi naman ako cabinet secretary, hindi naman ako cabinet official, sabi ko hindi naman ako siguro covered by the order," he said.
He said that before he attended the hearing, he told his superior that he would testify and at the same time would get copies of the study made by the UP experts.
"Nagpaalam naman ako, tapos sabi ko, kukuha ako ng dokumento dahil walang kopya ang ibang naimbitahan," he said.
Drilon said he would send both Ermita and Cortes copies of the legal opinion of the UP Law Center.
He said the Senate would also provide legal assistance to Gonzales.
"He is a lawyer himself. He should be able to defend himself. But yes, if they request that, we can provide assistance in terms of certification that, indeed, he came here upon the invitation of the Senate," he said.
