    Default Breach of contract?


    elow guys.., i really need your advise and opinions regarding my case of breaching of contract to my present employer...yep i know its better to have legal advise from a lawyer but still needs your idea guys...


    i have signed a 2 years contract with my present employer now (but regular nako) and also signed a promisory note na if ever i cannot complete the 2 years there is an amount to be paid by me basing on how many months in the company. The said amount is " nagkadako from the first month to the 2years"...Ang amount nga ilang gibutang monthly dont have an accurate computation why they come up that amount...and mao daw to amo bayaran for the loss og sa training daw nila but la man mi proper training kami2 lng gani explore and then ala man sad pako napadala nila gawas aron ma train...

    And now my problem is i have or i should have to resign even i cannot complete the said 2 years contract..,theres still 3 months to complete but there is a need jud to resign and grab the opportunity given by me (kay kinahanglan jud). The company will force me to pay the said exact amount on the contract? Is there a chance nga magamay akong bayranan or damages coz as what i have understood nga breaching of contract is you have to pay for the damages for the loss but i have 3 months nalng man before ma end akong contract so maka ask ba kaha ko nga the remaining months akong bayaran as damages sa akong pagresign?Magkadako ba diayang payment nga hapit na nuon mo end?

    It would depend sa company... but I doubt gukdon paka nila..
    Actually, that none compete clause thing is a total joke. Well, I'm sure naay mu react but whatever nila.
    The Law states that no company can and will hold an employee from getting a better job.. (it's something like that)
    Same is true with call centers.. they make you sign this none compete clause so you can't transfer call centers.. but if you're no one important like an agent, they'd let you go without any problem.. cguro if you're not one of the really important people who holds secrets from your company (according to my former officemate ka-ng mangawat diay na sila ug suka ug toyo sa atbang na company hihihihi) so yeah.... don't worry about that.

    ^ yup tinuod ni.. like daghan na au agents nga mu resign lang nya wer asked to sign a bond para d maka balhin.. pero so far. mao raman ghapon.. mao ranay ika lugi sa kompanya kng ilaha pana gukdon.. mu bayad pa sila abogado file pa case... nya imagine pila gud ang mu resign.. pila rasad ang mu puli.. so quits quits ra.. so most of them .. dili nalang..pero this is not a guarantee... depende lang jud na.. kung important ka sa company.. probably langay langayon lang cguro ang pag process sa imo clearance... or something similar..

    HI GUYS, if ever naman you signed a no compete claus, if you want to apply to a company in the same business, you can just ask a written consent from your previous employer. Yes, siguro makagukod man jud ta anang no compete clause kung tahay kasuhan ta, pro imagina nalang the hassles and money that will be involved if ever, not to mention sleepless nights. hehehehehe ngayo nalang mo written consent. mao na ako gibuhat dati with my call center employer.

    ^ true sad.. depende sa employer...naa uban mu approve.. naa uban dili... so company's discretion nalang cguro

    depende ra jud na sa company ug unsaon nmo pag defend imo side..why would they let u pay for a training bond nga ikaw2 ramn kaha ug wla formal training?

    that is if u muhatag ang employer, muhatag guro na if mubayad ka sa bond... hehehhe..
    i doubt muhatag ang employer.. labin na powerful white guys.. toink toink.. katol!

    di ka magukod ana sa company oi...di nuhon ka makakuha ug Certificate of Employment...kay ug tinuod pa nang magukod ta nila ay kadaghan anang AWOL sa call centers...gawas nuon kung naa kay nabuhat lain nga pweding mahimong dakong rason para gukuron ka sa company...okies? so kung ok ra imong records dha...resign daun ayaw kahadlok anang breach of contract...
