Top of my head, another big one is Michael Yang. But he isn't running for public office. Wala koy lain mahuna hunaan karon.

I believe Michael Yang is a private person and not running for public office. So, he is presumed innocent until guilty.

A simple google would say that 4 days ago, PDEA says they are still investigating Michael Yang's involvement.

For people running for public office only.

The President released the Narco List, somebody asked if it was a violation against "presumption of innocence".

Panelo countered that the people have "the right to know" as ensured by the 1987 Constitution itself.

For me though, it should have been the doctrine of the "publics right to know" versus "the right to privacy" .

Releasing the Narco List doesn't automatically mean that you are guilty though.

You still have the recourse of clearing your name or even going to the courts for libel.


Presumption of innocence are settled in court and not in the court of public opinion though.

Wala pa ta naabot sa courts ani. Ang issue sa ato conversation is the inconsistency by which Duterte treats Polong compared to other people. Duterte, through Panelo, said that those running for public office are fair game and that they are guilty until proven innocent.

Polong is running for public office. There are a lot of issues hounding Polong. Using Duterte's logic, Polong is guilty of ALL these issues. People have a right to know diba? That narco-list alone violates the right to privacy of the people in it kay it exposes them and their families to public scrutiny. But why is Duterte so silent about Polong?

Wala toy labot ang libel sa gi ingon na doctrine ni Panelo kay he mentioned libel as a defense against the list.

Really, I would like to watch the entirety of the video before really delving into this.

Panelo as a lawyer, I don't believe he would prescribe to the idea.

I would give a clearer opinion when I'm done watching Panelo's conference though.

Again, I think this is an issue of .

People running for public office, and "the public's right to know" vs "Right to Privacy".

I think presumption of innocence is only secondary when the above is answered.

Also, you can't claim presumption of innocence, when there is no case.

Also, of course you can claim. That constitutional guarantee is always applicable even when there is no case. Like you said, preliminary investigation. There is no case yet, but the presumption is already there.
