Agree ko ani bro, dapat dako2x na ang sueldo sa mga contractual, bisan tingale dili kaayo parehas ang benefits sa mga regular employees or defer lang ba kaha gamay.

Some other companies naa pa gani na silay contract completion bonus.

I don't know lang if pwede bang pa ubsan ang sueldo if i convert naka from contractual to regular, I've heard nga ang sueldo dili pwede pa ubsan, pero I don't know if mo apply na siya if naay change of employment status like from contractual to regular.

Dili sure pero murag si Drilon man tingale. Pero dili sure bro.

    ----

I think the intention of the law in all fairness lang was let us say fair towards the employee. Example, after 6 months, i evaluate ang empleyado kung maayo ba for regularization, in an unlikely event nga dili maayo ang performance, dili ipadayon ang contract.

Or kung na ayunan, either himuon ng regular or i extend ba kaha for another say 6 months for probationary period, after ana i regular.

    Maayo man ang balaud.

Ang problema lang ani kay murag wala na ma fit sa nature sa work for example kanang naa sa MEPZA, ang operation anang mga company like kanang sa mga parts sa sakyanan ba kaha, or mga lens, or mga electronics, naa man gud uban ana nga naay time mo down gyud ang production, meaning for example modagan ug 3 to 6 months nga walay order from outside the country.

Kung walay order or project, then you have 3,000 to 6,000 people working in your production facility, ang company ana kutasan gyud ug asa mangita ug para sueldo ana.

Mao na ang uban mang retrench, manangtang, or even mo stop operations. One of the major entries nga mo drain sa imong finances is salaries and wages, hasta legal benefits, naa pay bonuses. If dili ka mangtangtang ug tawo, maahat kag shutdown or move somewhere else, to put up shop. Kay dili man ka sustain ang imong income with the concurrent production.

Of course ang empleyado will never care about that, he has himself and his family to feed, maong mangita na siyag stable fixed monthly income kay ngaba ug gamay nga sueldo basta kay naa lang mareceive kada buwan, sort of stability.

Ang tenure comes next to stability, if stable na, ang sunod pangayo-on is tenure na pud. Meaning kanang imong stable income naa kay assurance nga madawat na nimo hangtud sa kaya pa nimo mo trabaho with benefits upon retirement.

With tenure this is where ang balaud vs business sense comes in.

If you are on the side of the company or the business owner, naa kay 3,000 to 6,000 ka employees, imong ihire... and kahibalo ka nga even one month to two months nga magshutdown ang company kay walay

Basic salary sa manufacturing based sa on the link is at 475 daily.

Official Website of National Wages and Productivity Commission

Example 475 x 3,000 = 1,425,000 per day. Kung mag shutdown ug 1 month lang, kay walay order that is already 42, 750,000 ..

That is already 42,750,000 ... That is 42 million loss nana...

Mind you naay uban company nga magshutdown ug tag 6months.. and other companies like kanang mga dagko kaayo kanang Taiyo Yuden naay uban tag 5k to 6k na ilang employees naa diha.

naa sa mga 80 Million ang monthly losses i times pa nimog 6 example mag shutdown ug 6 months. 480 million pesos in losses.
Manirado nalang ang company kung ingon ana.

Mao ning naka ingon ko nga affected gyud ang mga international companies, and even the local ones, kung i full implementation ni ang pag tangtang sa contractualization.

Maong digong is treading lightly gyud ani kay dilikado mo collapse ang market or the economy itself kay manglupad ang lain companies, mamalhin pa nag China, India, Vietnam, Indonesia, Malaysia kay naay mga barato nga labor didto.

i disagree regarding sa good intention sa law. with all those loopholes nga nakita karon i think murag naay something hokey pokey. naa man daghan paagi bisan wala ang endo. pwede man ang company mag probationary period para mahibawan if bulok ang empleyado. regarding anang shutdown.pwede raman settlements. as i've said ok rako sa contracts pero at least lang completo ang benefits pud unta. dapat unta ila butangan daghan safe guards ang law. same way pwede pud nila butangan safe guards para di pud ma alanganin ang kumpanya. like tax incentives.

nagbukal man dugo ni trillanes diha sa pic.
Agree bro, ang kana man gud benefits naa man gyud na siya, ang Legal benefits like SSS, PhilHealth, ug Pag-ibig naa gyud na sila, mao na ang minimum required by law.

Naa lang gyud uban mga agency nga either dili mo bayad or i delay ang payment, diha na magdala ug bati nga name sa manpower contracting.

Ang probationary period is actually sa balaud is 6 months kabalo naman tingale ta tanan ana, after ana if dili tanggalon for due cause, automatic by law regular.

Ang intention anang after 6 months is good in a sense nga sakto na tingale ang 6 months para ma evaluate ang tawo sa iyang performance. Ang resulta if ikaw ang company nay tipid, himo-on ang contract nga 5 months lang. Unya after 5 months i renew.

And I agree with the "labor-only" contracting gi ingon ni Attorneybirdman. Mao na ang endo nga gi ingon ni digong.

Naa man gud uban nga walay financial capacity, tools and the like nga murag ang tawo ra gyud ang gi supply, walay training, wala tanan.. Murag nahug na nuon nga ang commodity is ang tawo.
