Fact: machinery used in a business must by law be taxed. (ex.: printing presses for a magazine publisher, or escalators and air conditioners in a mall.)
Fact: In SM's tax declaration, they declared ZERO escalators, elevators, generators, or air conditioners in Seaside.
Fact: Using this as an excuse, SM under-declared their taxable value by almost 2 BILLION pesos.
Fact: In mid-2016, I wrote the management of SM a letter reminding them to fix the setback violation that DPWH reported more than a year ago, even before I became mayor again. The violation is public information; you can Google it
Fact: They sent me a letter in response saying they were too busy at the moment and that they would fix it by January. Fine, chance.
Fact: It is now March. NOTHING has been done.
