A 17-YEAR-OLD boy will face trial after he allegedly detained two 11-year-old boys and forced them to sniff illegal drugs in Barangay Bangbang, Cordova.
Assistant Provincial Prosecutor Al Rey Ouano found enough evidence to charge Joey (real name withheld for being a minor) with serious illegal detention in relation to Republic Act (RA) 7610, or the Special Protection of Children against Abuse, Exploitation and Discrimination Act.
The accused was also charged with violating Section 10 of RA 7610 for forcing minors to commit crime and cruelty and with illegal possession of firearms.
With discernment
The complaints were resolved by Ouano, after Joey opted not to avail himself of his right to a preliminary investigation during the inquest.
The cases are bailable.
PO2 Erwin Rebada and PO2 Noem Risallosa arrested Joey last June 18 after victims Danny and Mar (real names withheld) reported the incident.
They also allegedly recovered a .22 pistol from Joey’s possession.
A social worker issued a certification stating Joey acted with discernment when he carried out the crimes, police said.
The victims, in their sworn statements, accused Joey and his brother Ed (real name withheld) of detaining them and forcing them to sniff shabu twice.
They said they were strolling in their neighborhood last June 17, when Ed called out to them around 10 p.m.
Ed allegedly instructed them to steal coins from a water dispenser owned by their neighbor.
Danny and Mar failed to carry out the order because people were hanging around near the dispenser.
Joey allegedly let them in to another neighbor’s house, where Danny allegedly stole two plastic receptacles containing money.
After counting the money, the group went to Ed’s house where the victims were allegedly forced to sniff shabu.
Joey allegedly ordered the two boys to return to their neighbor’s house to steal a cellular phone.
“Wala mi nila gipapauli kay kahibawo sila nga gipangita mi sa among papa. Bunalan daw mi nila kung mouli mi (They did not allow us to go back home because they knew our fathers were looking for us. They threatened to spank us),” Danny said.
At large
Ed was also charged with violating RA 7610, but he remains at large.
RA 7610 defines child abuse as maltreatment of a minor, which includes “psychological and physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment” and “any act by deeds or words which debases, degrades or demeans the intrinsic worth and dignity of a child as a human being.”
The law punishes any person “who shall commit any other acts of child abuse, cruelty, or exploitation or to be responsible for other conditions prejudicial to the child’s development.”

Again, I think, with this age bracket and hooked up with addiction and without any means to support it,
the culprit of the reason behind is quite clear.
