    Default Question regarding Forced Duty on Rest Days


    Pwede ba na nga file-lan ka ug AWOL or Administrative Charges kung dili ka mo duty sa imong Rest Day?

    For example, normal working day per month kay 26 days. Then ang remaining 4-5 days kay day off / rest day na nato.

    Here comes the time nga pa dutyhon ka sa imong remaining rest days, if dili ka mo duty, file-lan ka ug AWOL.

    Sa mga istoryans nga HR specialist or Law practitioners, please give your inputs. Thanks!

    Hmm possible if ne request ang imong amo na pa dutyhon kah den wala ka mo duty, kay naay man na sad sa contract na pwede sila mo request gyud na mo duty especially if needed gyud. Or naa bakay na basa na similar anah? sa imong contract?

    But cguro the following month ila lang pud na ehatag sa imo ang restday, murag tapal tapal style, Labi na og ang imong restday kay dili bitaw fixed na date.

    But sa law gyud dapat naa gyud 1 restday in a week. but naa man gud gitawag companies prerogative pud. heheheh

    Since naa man tah sa company so under gyud tah sa ilang rules, den apply ang law if mo abuso na pud sila pag ayo.

    I suggest as an employee mas maayo tuman lang sa ilang request para maayo ang atong relasyon sa company. Kay in the first place sila man pud na hatag income nato.

    Wala man problema kay naa man nuon overtime pay, but I think it diminishes our right to take a rest if ang company maka afford ug bayad sa atong rest days para pa dutihon ta.

    Of course, maka affect jud sa appraisal if dili ta mo duty, pero dapat "request" ra unta... dili ORDER nga pa dutyhon ta or else e AWOL ka. IMHO, dili man siguro na matawag AWOL kay especially if monthly employee ka, imo naman ge dutyhan ang required number of days nimo.

    Any passages sa Labor Code or any Philippine Law para ato ning ma counteract sa ingon ani nga pang abuso sa atong mga company?

    It is either a yes or a no. It depends on your contract, Bro. If the company stated somewhere in your contract that you may/may not be required to work overtime. Also, in most cases, you have to have some memo to sign before you will be asked to work on your non-working days. Without these, then it is not lawful for the company to ask you to work on your day-off.

    Para maklaro boss... NO, wala sa akong contract nga dapat ko mo duty sa akong rest day. I think there is no such thing nga pa pirmahon ta ug contract nga walay Rest Day or Day Off, ma void ang contract ana.

    Then, by all means try to speak with your HR or your Manager boss.

    In our workplace, if there's a time wherein we're asked to render OT on our RD's, then we are asked to sign a memorandum. If you signed to the memo and you get absent on those days, then you are going to be tagged as AWOL. If you won't sign it - for which I don't think anybody would ever do except if you have some valid reasons, then you won't be tagged as AWOL if you'd be absent.

    Before ta mo attack sa management or HR, dapat andam ta sa legal basis. Dili raba malikayan naay mga company nga maro2x, unless mohatag ka ug verse sa labor law or any philippine law, mopa ugat or mo continue ra gehapon ug pang abusar.

    Ang sa amoa, wala mi gepirmahan nga memorandum or contract nga obliged mi moduty sa among RD.

    That's why, if naa man gani HR specialist or law practitioner diri, maybe maka tabang mo para ma tuk-an sila, kung naana tay legal reference.

    depende na migo kung ning sign ka sa imong OT request, but there is no such thing as an AWOL during rest days. lain pud na siya nga case, but dili AWOL. and remember that vacation leave is not applicable during rest day and how come nga ma AWOL ka. Kana kung during rest day dili ka mo duty and the following day which is regular then absent pud ka wala ka nag file og leave, wala pud ka manawag, mao nay AWOL.
