    Allow me to chip-in my 2 cents on the case: The "BOSS" committed an act of constituting sexual harrassment.

    section 3 (a) (1) of RA 7877 states that "sexual harasmment is COMMITTED when a sexual favor is made as a condition of... and refusal to the sexual favor may result... to the employees deprivation or impairement of rights"

    In this situation, the pretty subordinate did not suffer such. But it is clear that "the BOSS" attempted to commit a sexual harrassment act.

    what could be the most appropriate penalty for this? or is this a case of just a mere indecent proposal/seduction?

    It would fly in the face of logic if a person, exercising moral ascendency over another being the boss, would be able to escape prosecution for sexual harrassment if he could argue that he is not liable becoz his amorous advances were not contingent on any promise,favor,or accomodation to the victim. To my mind, any one making indecent proposals, who is otherwise prohibited by his status from doing so, commits sexual harrassments if he is in a position to do harm becoz of his position. If his advances are rejected, and he persists in doing so, it creates an intimidating , hostile and offensive environment to the object of his lust. that puts the case squarely under the acts prohibited by RA 7877.

    at any rate, before we take action on this case, please take note the decision in the case (GATBONTON vs. NLRC) Jan. 23, 2006, in this case the court rebuke the employer for taking action against the employee based on rules on sexual harassment that have not been published prior to implementation.

    As I understand, if you are someone in position of influence to the one your flirting w/ it is already sexual harrassment. Even if you have no intention of taking advantage of your position, the subordinate will still be affected because they will fear that you will be biased in the future just because of the rejection. Ive seen this happen and I salute those who are able to stand their ground.

    Thats the main reason why relationships among co workers are not allowed in most companies. Kung naa man i-bulag jud na cla ug departments kay kapoy kaayo tan-awon ng pabor pabor tungod kay uyab o kabit. It only causes problems in the organization.

    lets try to sum things up...

    we have our own perspective with regard to this matter.... and i would just like to remind you that this is PERSONAL already.... some women would go for practicality sake, some has a character of a lawyer like, some may say YES, others may say NO,some would say Sexual Harrasment, others would say seduction?.., some would say Professionalism, others would say its rabid baboon in heat esp., some would like to kick there boss's balls and look for another job, and others would stay to get fast promotion (if its possible).. i've been to that situation by the way, well, not necessarily me, but a good friend of mine, unfortunately, he didn't get the 100% scholoraship that he thought he could get after he has been "sucked"..tsk tsk tsk.. anyway, back to the topic....

    i hope 1 virtue can make a difference... its RESPECT.... if the boss is doing his seduction thing inside the office, then its very well said, action speaks louder than words....

    no RESPECT = kick boss's balls and find a new one...

    oh and BTW, their right you know, that "sometimes?" NO doesnt mean YES.... when its NO... its no.. mga walay clear lang ang mga tao nga mag NO when it means yes.... there crazy..... no offense to those nga dili pa firm ha...
