    Investigators get name of DOJ marshal accused of raping girl

    THE Guadalupe Police Station in Cebu City obtained the real name of the marshal who allegedly raped a 21-year-old girl under the Witness Protection Program (WPP) of the Department of Justice (DOJ).

    Guadalupe Police Station Chief Andres Bayarcal revealed the real name of “Billy,” the WPP security marshal, in an interview over radio dyHP but Sun.Star is withholding the man’s name pending his comments.

    The Guadalupe Police Station is investigating the case and obtained the name of the marshal from the WPP.

    Charges have not yet been filed against “Billy.”

    Bayarcal said the police will gather affidavits from the alleged victim.

    “We will also have to depend on the DOJ's request on the investigation of the case, kung naa pa man gani kulang (we’ll check for more evidence),” Bayarcal said in a phone interview.

    He said they still cannot arrest the marshal because they do not have a warrant from the court. He added that the filing of charges in court will also depend on the Office of Prosecutor, which will determine if there is enough evidence to elevate the case to the trial court.

    Safehouse

    The 21-year-old girl, who sought protection under the WPP after she was allegedly raped by two men last year, accused the marshal of raping her several times between January and March this year in a WPP safehouse in Barangay Guadalupe.

    Anti-crime crusader Thelma Chiong said in a radio interview that Claire (real name withheld) would not have been exposed to risks if she was in the care of a female social worker at the Department of Social Welfare and Development (DSWD).

    Chiong said that Claire should not have been placed under the WPP because she is a victim, not a crime witness.

    DSWD 7 Crisis Intervention Unit (CIU) acting chief Ligaya Dael said Claire's case was never referred to them.

    Separate

    She said abuse victims are temporarily placed in DSWD safehouses where girls are separated from boys.

    Male victims of abuse are handled by male social workers while the girls are supervised by female social workers.

    “We shelter the victims if they received threats and relatives cannot take them in custody,” she added.

    Claire got accepted to the WPP reportedly because she received threats.

    Dael said the police can refer a rape victim to a local social welfare office after recording the incident in the blotter. A social worker will then assess the state of the victim.

    Benefits

    Under Republic Act 6981 or the Witness Protection, Security and Benefit Act of 1991, any person who has knowledge of a crime and will or has testified in court or before Congress can avail of witness protection benefits.

    A person who has participated in the commission of a crime and who desires to be a state witness can also be placed under the WPP.

    A beneficiary enjoys security protection; immunity from criminal prosecution concerning his testimony; secure housing facility; livelihood assistance; and travel expenses and subsistence allowance while acting as witness.

    Beneficiaries also get free medical care and medicines if they become ill or injured while acting as witnesses, as well as burial benefits. They also get free education up to college.

    If the girl’s claim is true, the guard should be immediately suspended while an investigation is ongoing. Putting him in charge of a safehouse is akin to designating Dracula to watch over a blood bank.
