    They have real property before, when we were still friends they purchased 2 rice mills in Toledo and maybe some land and they put it in his wife's name way back year 2000-2001 but when I tried to tell them and ask my money back, after a year, they told me that they already sold the 2 rice mills which I don't know if it is really true. They really hide any possible evidence that could possibly pen point out them to be guilty. And to avoid if ever time comes, nothing will be sheriff from their property.

    This is really really hard, I know its my faults to trust them so much. If I don't win this , I just want him to be out here in the Philippines...

    it is my representative actually who started this thread and help me seek help and find good opinions. She is the one who type and it's my
    opinion she is trying to raise here. I tell her this is what your going to ask and that is what she is doing in this forum...

    Tsk! Tsk! You need a very good lawyer for this. It's going to be quite hard if you don't have enough proof.

    But first you have to make up your mind... Do you just want to scare him or do you want to get your money back?

    Don't ask help from public defenders as they're too busy with lots of "pro bono" cases. You should need to hire an experienced lawyer. One who would agree to get only a percentage of the amount (that you would be able to retrieve from your friend) as his legal fees.

    I hope you won't stop trusting people. It's just that when it comes to huge money matters, always, always have it written down in black and white...be it with a trusted friend or family member.

    I agree with arnolfu, you should make up your mind whether to scare him, harrass him or get your money back. There are some lawyers who accepts cases on contingency basis.

    i agree with arnulfo and lissa.. hire a private prosecutors if you really want to prosecute him and to collect what is due to you.. and just make an arrangement with the lawyer that his fee is based on the percentage of the amount collected.. basically that wud be 10-15 percent or some lawyers will collect 20 percent.. but its much better than recovering nothing of the said amount.. dont worry with the rice mill coz that might be labelled as a questionable trasaction entered to defraud third person (you) especially when the property was sold to a relative and is in bad faith, but bad faith is hard to prove... and considering as what you have said that you'll just be hiring a representative for you to keep track the case that might be DISMISSED for technicality... defendant's lawyer might file a motion to dismiss for no cause of action or improper party.. because basically those who are aggrieved or whose rights are infringed are the one who is protected by law.. anyway that was just my anticipation for only a real good lawyer could tell you the real deal... GOD SPEED!!

    It's very sad, I know it is hard to prove. If i bring this to court, it takes a lot of time, energy and lots of money once more. It would be easy
    if I there in Phils. but to much energy for me to get there for nothing as he will just bribe the just maybe!
    Maybe breaking his legs and arms would be enough, though I would not shed tears for him when it happens...

    It indeed takes a lot of effort and energy, not to mention money, if you will file a case against your ex-friend, specially if you really intend to get back your money. It would take years also. But just to make it a little bit hard for him, a criminal case would be enough. Just file a complaint before the prosecutor's office. For sure, if you can provide sufficient evidence to convince the investigating fiscal that probably a crime has been committed, most likely a favorable resolution will be issued from which an Information will be filed in court. From there, the public prosecutor can already take charge.

    Just imagine the headache, albeit temporarily, that bastid friend will experience once a warrant for his arrest will be issued. Well, he could bribe some peeps for the dismissal of his case but at least you made him spend You may not be fully assured of justice in a silver platter but at least you were able to pinch his swindling butt.
