    PCG clears MV Ming Yuan off poaching allegations; Immigration demands vessel to settle penalties for entering PHL waters without notice

    DOTC-PCG: Joint inspection conducted by the Port State Control and the Department of Environment and Natural Resources (DENR) in Cebu has cleared a Hong Kong-registered vessel from earlier allegations that it was extracting pebbles and sand from Malapascua Island as it entered Cebu's vicinity waters without notice of arrival.

    MV Ming Yuan was intercepted by Coast Guard Search and Rescue Vessel BRP Nueva Vizcaya (SARV-3502) around 6:00AM of Sunday, 16 June approximately 11NM off Malapascua Island in Cebu.

    The 19,998GT vessel was held by the Coast Guard for entering Philippine waters without pertinent documents.

    While anchored between Malapascua and Carnaza Island in Daan Bantayan, Cebu, a joint boarding team composed of members from the Bureau of Customs (BoC), Bureau of Immigration and Deportation (BID), Bureau of Quarantine (BoQ), Coast Guard District Central Visayas (CGDCEV) and Coast Guard Station (CGS) Cebu, boarded the vessel to verify earlier reports that it was extracting pebbles and white sand from the area. However, the inspection yielded negative results as the cargo holds of MV Ming Yuan were all found to be empty.

    It was also only during the onboard inspection that the authorities found that MV Ming Yuan did not file any Notice of Arrival to the concerned government agencies prior to entering the country's waters.

    Meanwhile, representatives from the BID have confiscated the passports and seaman's book of the crew of MV Ming Yuan.

    An Immigration officer stated that the vessel violated immigration laws for not notifying their office on the vessel's arrival/presence. The master of the ship was thereby advised to coordinate with BID-Cebu, through their local agent, to settle their penalties prior to its departure.

    Further, a letter from BoC-Cebu date 20 june 2013 stated that MV Ming Yuan violated/omitted the following provisions of the Tariff and Customs Code of the Philippines (TCCP):

    1. Section 1002: Control of customs officials over boarding or leaving of incoming vessel and over other vessel approaching the former;
    2. Section 1003: Quarantine certificate for incoming vessel;
    3. Section 1013: Arrest of vessel departing before entry made in relation with section 2513;
    4. Section 2530: Property subject to forfeiture under tariff and customs laws paragraph F and L;
    5. Section 2534: Seizure of vessel or aircraft for delinquency of owner or officer.
