Canadian charged for having s*x with minor

SINCE she was bored, 15-year-old Annette (real name withheld) sent a text message to Canadian national Garry Dwayne Kevol, telling him she’d want to meet and dine with him.

She also told the 59-year-old foreigner they could go somewhere else afterwards.

So they met inside a fast-food joint in Barangay Lahug, Cebu City.

Annette expected what would happen next because she had known Kevol since January: she went with the foreigner to his condominium and had *** with him. She was paid P1,500.

“We had sexual intercourse for seven times…as far as I can recall,” she said.

In these encounters, Annette said, she was paid P1,000.

A National Bureau of Investigation (NBI) 7 team led by supervising agent Bernard dela Cruz arrested Kevol outside the condominium and rescued Annette last Friday afternoon.

The agents had placed Kevol under surveillance over complaints that the latter allegedly used minors for ***.

A violation of Section 5 (b), Article 3 of Republic Act (RA) 7610, or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act, was filed against Kevol before the Cebu City Prosecutor’s Office.

The law punishes any person who “commits the act of sexual intercourse of lascivious conduct with a child exploited in prostitution or subject to other sexual abuse.”

Finding enough evidence, Assistant Prosecutor Liceria Lofranco-Rabillas filed the case in court.

She set the bail at P200,000 for Kevol.

During the inquest conducted by Assistant Prosecutor Mary Ann Castro, the complaint was dismissed for the accused’s arrest was improper.

Inquest is a summary inquiry that is meant to check if the warrantless arrest of a person can be justified by probable cause.

But Rabillas overturned Castro’s decision, saying the agents’ warrantless arrest was valid.

She said dela Cruz’s team gained personal knowledge about the accused’s alleged crime after they interviewed four minors.

“It must be stressed that prior to the arrest, (Kevol) was seen in the CCTV inside the condominium’s elevator with a girl who appears to be a minor and is 10 years or more his junior,” said Rabillas. “(She) appears not to be his relative as he is a Caucasian while the girl appears to be a Filipina.”
