this is a late reply pero ga wonder ko sa pag read nako ani nga thread asa natong mga NIANA sa mga first 5 pages nga serves him right daw nga namatay.. so now! kung kamag-anak pa ninyo tong nahitabo-an unsa kaha ma feel ninyo sa pag ka hibaw ninyo sa tinood nga wala gud diay sala!?

NATIONAL Bureau of Investigation (NBI) 7 Director Antonio Pagatpat insists they are the lead agency in the investigation on the death of a shopper inside the Metro Gaisano on Colon St., Cebu City last April 12.
“The PNP had the opportunity to investigate the case before, but they let it go,” Pagatpat told reporters yesterday, adding that the family of victim Mario Alfie Ducayag asked them to conduct the probe.
He said they are willing to schedule a case conference with police investigators. They may also file charges against the suspects early next week.
Cebu City Police Office (CCPO) Acting Director Marciano Natuel Jr. said they are willing to coordinate with the NBI 7.
“Naka-secure naman mi og affidavits sa witness nga among nakuha (We were able to secure the affidavits of two witnesses). If the NBI needs these for the case then we are willing to give these to them,” he said.
Lack of trust
Metro Gaisano chief security officer Mauricio Doblados Jr. and house detective Melvin Boyles submitted an affidavit that tagged security camera operator Jeffrey Aquino as the one who mauled Ducayag inside the security personnel office.
The CCPO tried to file a homicide complaint against Aquino before the city prosecutor’s office last Monday afternoon, but the police had to release him after Ducayag’s family prevented them from doing so.
“Para dili nalang gyud gubot, nilikay nalang mi and kami nalay nirespeto sa ilang decision (We respected the family’s decision and we also wanted to avoid a commotion),” Natuel said.
Police would have also been held liable if they continued to detain Aquino without a complaint.
The victim’s family said they didn’t want the police to file the complaint because the police’s evidence is weak.
“We are disappointed with them (police),” said Ducayag’s sister Marie Shantylle.
She said they want the NBI 7 to handle the case because they cannot trust the police, especially after PNP Crime Laboratory medico-legal officer Dr. Nestor Sator came up with allegedly erroneous autopsy findings that showed her brother died from asphyxia due to pulmonary tuberculosis.

Last April 12, Ducayag was accused of stealing a pair of sandals worth P395 and was brought to the store’s security personnel office where he died.
Witnesses said the victim paid for the item, but he just lost his receipt.
‘Long shot’
Meanwhile, Natuel said they were able to arrest Aquino last Sunday, or 16 days after Ducayag’s death, after Doblados and Boyles executed their affidavits.
But lawyer Ian Vincent Manticajon said the police should have only invited Aquino for questioning.
“It is a long shot to justify the arrest was a hot pursuit,” he said. “They don’t have a personal knowledge that the person committed the crime because they just based their arrest on the affidavit.”
He, however, said that hot pursuit rule has no specific time frame as to when to arrest a suspect.
The PNP legal service’s primer states that a police officer should have personal knowledge that the suspect committed the crime.

Witness recants Ducayag nabbed in store counter 5/2/2013
A new twist developed in the investigation into the violent death of 23-year-old shopper Mario Alfie Ducayag as a witness recanted her earlier statement.
The female guard of Gaisano Metro Colon who first said she apprehended Ducayag recanted her statements before the National Bureau of Investigation (NBI).
Margie Gaser said Ducayag was not arrested as he was about to leave the department store last April 12, as her earlier testimony revealed. Instead, she said, Ducayag was arrested by security guards when he returned to a cashier counter to look for the receipt of a pair of sandals he bought.
“Gaser said she was instructed by chief security officer Mauricio Doblados Jr. and security guard Melvin Boyles to tell any investigator that she apprehended Ducayag while he was headed out of the mall and was stopped for failure to show a receipt,” NBI Agent Bernard dela Cruz told Cebu Daily News.
Gaser admitted that her earlier statement about Ducayag's arrest was “fabricated.”
Lapses
Cerwin Eviota, spokesman of Metro Gaisano, reiterated the willingness of the department store to cooperate with the investigation done by law enforcers.
“ We urge the NBI and the police to dig further into the case to get a full picture of the whole incident and bring those responsible to justice, and clear the names of those who had nothing to do with the incident. We rely on the competence of our authorities to find the truth.”
Eviota said there may be “lapses” on the part of the department store’s security force but said they are ready to address it.
“We're reviewing procedures to make sure this won't happen again,” he said.
A case conference between the NBI and the police is scheduled today.
Based on her statements to dela Cruz, Gaser said it was Ducayag who y went to counter 7 of Metro Gaisano-Colon to look for the receipt of the pair of sandals he purportedly purchased.
Aside from the sandals, Ducayag also bought infant milk formula and other food items.
Since Ducayag could not explain why he didn't have any receipt for the sandals, dela Cruz said mall supervisor Juvelyn Magdadaro instead called the assistance of the security guards who acted as store detectives.
The store detectives brought Ducayag to the store's investigation room where he was allegedly mauled to death.
“Malayo-layo pa tayo. Now, Doblados, Boyles, and Jeffrey Aquino have been pointing fingers at each other as to who actually mauled the victim. We will ask all of them to appear before the NBI,” he said.
