    Death of ‘Shoplifter’ Mall officials cooperate with NBI investigation

    CEBU, Philippines - Officials of Gaisano Metro Colon Branch went to the National Bureau of Investigation office yesterday to show their full cooperation in the investigation on the death of a 23-year old man who was accused of shoplifting in their mall.

    Cerwin Eviota, Gaisano Metro’s spokesperson, also said they informed NBI-7 Regional Director Antonio Pagatpat that they asked the agency of the security guards who arrested Mario Alfie Ducayag to dig deeper in their investigation.

    Reportedly, five security guards were suspended after the incident.

    Ducayag was allegedly mauled by the security guards after he was accused of shoplifting.

    Eviota said that it is the responsibility of the security guards to implement security measures and interrogate apprehended persons humanely.

    Primo Cadampog, Commission on Human Rights investigator said under the Constitution, every person has the right to life.

    The apprehended person should be given due process and opportunity to answer and mauling should be avoided.

    Earlier, the family of the Ducayag, a resident of Tuyan, Naga City asked for assistance from the NBI after they were not convinced by the result of the autopsy conducted by the PNP medico-legal officer.

    The PNP medico-legal officer ruled that the cause of death was “asphyxia due to bleeding pulmonary tuberculosis.”

    However, the findings of the re-autopsy conducted by the NBI was different.

    NBI medico-legal officer Dr. Rene Cam said the cause of death was “due to traumatic nape injury due to hyper extension of the neck.”

    The vertebra of the spine of the victim was dislocated particularly cervical vertebra (C2) and cervical vertebra (C3).

    “It would be more on the traumatic injury rather than the asphyxia because the asphyxia did not affect both lungs. It only affected the left lung,” Cam said.

    Cam also added that since the victim died immediately, it could not be asphyxia that caused it but the dislocation of the neck because it compresses the spinal cord and could affect the respiratory center.

    He also explained that there was sufficient force applied at the back of the victim causing the spine to be dislocated.

    According to Cam’s initial findings, the contusion or bruise at the back measures 13 by 10 centimeters and linear in appearance that suggests a wood or nighstick was used.

    Contrary to the claim of the PNP that the case was pathological, Cam said the re-autopsy showed that the cause of death can be determined just by grossly looking at the tissue and that there is no need for any pathological examination.

    “If the second autopsy has more findings that can really explain the cause of death, then it would be the re-autopsy that would supervene the first autopsy,” Cam said.

    Director Pagatpat said they will be using Cam’s autopsy report in conducting further investigation on Ducayag’s death.

    They will be still investigating if the victim really stole items from the store.

    But Pagatpat said even if the shoplifting really occurred, it was not enough reason to kill Ducagay.

    “We are vigorously pursuing the investigation. In fact, that was my instruction to the agent yesterday and hopefully we can come up a very good result in few days time,” he stated.

    Pagatpat added that they are trying their best to find eye witnesses.

    They are also urging the management to allow their employees to give their side on the incident.

    “Lahat ng ito ay para sa hustisya at katotohanan,” Pagatpat explained adding that do not intend to outperform the PNP or anyone.— (FREEMAN)

    Mauling victim’s family to pursue complaint

    THE family of a man mistakenly accused of shoplifting in a mall in Cebu City will pursue charges against those responsible for his death.

    “Our priority now is to bury my son (on Sunday) and then we will make our next move afterwards. All is planned,” said 50-year-old Fe Soledad, mother of Mario Alfie Ducayag.

    Ducayag died a few days after being reportedly mauled by security officers inside Gaisano Metro in downtown Cebu City on April 12.

    Representatives of Gaisano Metro earlier went to Ducayag’s wake at the family home in barangay Tuyan, Naga City.

    They offered financial aid but the family refused. Cerwin Eviota, spokesman of Gaisano Metro, said they are willing to cooperate with the regional National Bureau of Investigation (NBI) in the investigation on Ducayag’s death.

    “We are also encouraging the security agency to dig deep in their investigation. The company will fully cooperate and we have mandated the security agency to do the same,” he said.

    Gaisano Metro has two security agencies supplying them with guards: Golden Sun Investigation and Security Agency and Negrense Security Agency.

    Ducayag, the third of Fe Soledad’s four children, was believed to be mauled by security officers of Gaisano Metro over allegations of stealing a pair of sandals last April 12.

    The NBI secured footage of the mall’s closed-circuit TV cameras and started viewing the tapes.

    The footage showed Ducayag’s apprehension and him being brought out of the mall’s investigation office.

    It also showed Ducayag being given medical attention by personnel of the Emergency Rescue Unit Foundation (ERUF).

    One of the guards, 22-year-old Margie Gaser, recounted the incident to NBI agents.

    She said she noticed Ducayag didn’t have a receipt for a pair of sandals he carried along with diapers, biscuits, and milk inside a plastic bag from the grocery section of Gaisano Metro Colon.

    Gaser, who is under investigation along with seven other persons, was placed under the custody of male guards who likewise acted as detectives inside the mall.

    She said she went with Ducayag in confronting the cashier who received payment for the sandals.

    “I left Ducayan at the cashier because I had to go back to my post to check items brought by customers on their way out,” she told Cebu Daily News.

    As practiced, all items carried by mall goers will be checked by security officers before going out of the establishment to find out whether or not they have a receipt to validate the purchase.

    Gaser said the next time she saw Ducayag was when he was brought by ERUF personnel towards the hospital.

    The female company nurse who checked on Ducayag’s condition couldn’t verify if Ducayag was already dead when he was brought out of the mall.

    Eviota said the two security agencies should answer the allegations since they directly dealt with Ducayag.

    “The responsibility is on the security agency to conduct themselves properly. It’s standard operating procedure of the management that when you handle people, you handle them humanely since they are still presumed to be innocent,” he told reporters.

    Based on the autopsy report of NBI-7 medico-legal officer Rene Cam, Ducayag didn’t die a natural death, contrary to what the police autopsy report earlier said.

    Cam said Ducayag died due to “traumatic neck injuries.”

    EVERY time Marie Shantylle Ducayag lifted her nephew to let him see the face of his 23-year-old father, the one-year-old boy would touch and hug the glass cover of the coffin.

    Nash Marfie then would mutter, “Papa Al-al.”

    The child calls out the nickname of Mario Alfie Ducayag, the man who died allegedly while being held for questioning by the security personnel of Metro Gaisano on Colon St., Cebu City last April 12.

    “Luoy kaayo tan-awon ang bata (The child look pitiful). Maybe he thinks his father is only sleeping,” said Marie Shantylle in a phone interview.

    The 30-year-old sister said his brother’s eldest child, Athena Shalvin, 3, does not know the real cause of her father’s death.

    “My brother was motivated to study for his children,” she said.

    Ducayag, a high school graduate, enrolled in a housekeeping course last February, hoping to land a job overseas soon so he could feed his children. He was separated from his live-in partner.

    “He had a charming smile and was caring,” she said. “He would defend me also, but he was not a violent person.”

    The quest for truth behind Ducayag’s death has reached Facebook, a social networking site.

    Marie said her cousin created the page: “Justice For Mario Alfie Ducayag,” which has 184 likes as of last night.

    “For two weeks now, our family continues to grieve, but we are now seeing the light at the end of the tunnel. Multitude of prayers has paid off,” said Marie’s relative Doris Navales. “Thanks to Bombo Radyo-Cebu family for continuously airing the story behind the heinous crime committed against Alfie. The public service they accorded to our family has consequently elicited kind-hearted volunteers who responded to their calls.”

    Metro Gaisano personnel accused Ducayag of stealing a pair of slippers, but an employee told Marie that her brother had already paid for the items.

    The payment was also registered in the cashier’s machine.

    He reportedly returned to the cashier to ask for another receipt, for the original one was lost.

    Marie was told that, usually, only a piece of a sandal is displayed on a rack.

    If a customer asks for the other piece to fit them both, the latter will get the other piece.

    The clerk then would accompany the customer to the cashier’s booth.

    “Whether my brother stole the sandals or not, they should have turned him over to the police,” said Marie. “What did my brother do that they inflicted so much pain on him?”

    Ducayag will be buried in a cemetery in Naga City, after a requiem in a Catholic church.

    With his sudden death, Marie said the future of her brother’s children is bleak.

    “I even told him that his study is an opportunity and God will open doors for him,” she said.

    One day, Marie said she opened the notebook of his brother. She said she could not help but break down.

    Ducayag did not write his own name.

    “In big bold letters, he wrote the names of his children,” said Marie.
