    MANILA: This is a clear case of perplexity. When I read the latest bluster against Senator Tito Sotto as an alleged plagiarist, my creative mind was set to thinking that, perhaps, if we followed the logic of those who are CATS, Campaigners Against Tito Sotto, if the CATS were right about plagiarism, the Reproductive Health Bill itself is the greatest example of plagiarism. And I was right, but Antonio Montalvan II beat me to it by 22 days - see his "Don't amend RH Bill, discard it" (22 October 2012, inquirer.net). After saying that the RH Bill has many provisions already in RA 9710 (Magna Carta for Women), he says:

    The RH bill also carried provisions copied verbatim - without any attribution - from RA 9262 (Anti-Violence against Women and Children), RA 8504 (Philippine AIDS Prevention and Control Act of 199, RA 7883 (Barangay Health Workers Benefits and Incentives Act of 1995), RA 7875 (National Health Insurance Act of 1995) and a panoply of other laws, executive orders, department program circulars and policy guidelines. The RH bill, in fact, is the greatest work of plagiarism ever to fool our people.

    CATS, hear that about the RH Bill? This is the clearest case of plagiarism!

    "What is the point of redundancy?" Montalvan asks. Among other things, he says the Women's Global Network for Reproductive Rights, headed by UP Professor Sylvia Estrada Claudio, has a goal of finding the "best practices for linking abortion rights to other social justice and human rights campaigns." Now I see the point of that redundancy; I see the link: A pro-abortion RH Law is an assertion of the woman's right to her body. The fight for human rights is behind the RH Bill. As for me, I do not subscribe to human rights; they are individualistic, antagonistic - your rights against mine. Rather, I subscribe to family rights; they are collective - our rights. The family is the basic unit of society, neither the male only nor the female only. The RH Bill is against family rights; it legislates the exercise of family rights unto the arms of the law. This is a clear case of perfidy.

    Man Asian Literary Prize-winning Filipino writer Miguel Syjuco and all the other CATS are for human rights, for all that they are worth. Such as the human right not to be plagiarized. What about the human right not to be accused of plagiarism without trial, without proof? This is a clear case of partiality.

    Syjuco, who resides in Montreal, is concerned about plagiarism in the Philippines, whose laws differ from those of Canada and the United States. Did he know that there is no law against plagiarism in the Philippines? Did he know that in my alma mater the University of the Philippines, as in his own Ateneo de Manila University as well as other universities, if you define plagiarism as merely copying and/or translating and using someone else's text without attribution, plagiarism by students and professors is rampant? Everybody does it. Show me a dissertation or thesis (in literature, if you wish), technical paper, lecture, presentation, article or essay and I will show you what you have missed - I've been editor for the last 37 years I can find your plagiarism in 5 seconds flat. So, assuming he is right about Tito Sotto, what special credibility does Syjuco have for decrying the plagiarism of one? As for Sarah Pope's claim to fame, just giving you the title of one of my essays is enough: "Sarah Pope: 'Tito Sotto is a plagiarist.' Look who's talking!" (12 November 2012, americanchronicle.com). This a clear case of the pot calling the kettle black.

    CATS member Miguel Syjuco says Americans Sarah Pope, Janice Formichella, and Peter Engelman have come out with a joint statement declaring that Sotto had "infringed on our intellectual property rights and plagiarized" ("Kennedy to Sotto: 'This is a clear case of plagiarism'," 10 November 2012, rappler.com). Miguel, Sarah, Janice and Peter, you don't issue a statement like that to the press, or even to the court, without attaching documents to prove your allegation. This is a clear case of trial by publicity.

    According to ANN, Pope writes for her blog, Healthy Home Economist, Formichella for the website Feminists for Choice, and Engelman works for New York University's Margaret Sanger Papers Project (author not named, 08 November 2012, femalenetwork.com). Actually, the complaint has not been filed officially. Nonetheless, about the news, Sotto said, "It's a welcome development because that will give me a chance to prove there was no such thing (as plagiarism in what I did)." This is a clear case of probity.

    In his latest post (10 November 2012, rappler.com), Miguel Syjuco attaches what appears to be a letter from Kerry Kennedy, President of the Robert F Kennedy Center for Justice & Human Rights based in Washington DC. In body, it's a brief letter of 278 words, but it manages to be long in accusation and short in argument, as it is based on hearsay! OMG, the daughter of US Solicitor General Robert F Kennedy accusing Philippine Senator Tito Sotto of plagiarism because some people told her so? Kennedy says, "This is a clear case of plagiarism, and it is my understanding that Senator Sotto has committed similar acts of plagiarism against a series of American writers and speakers. I urge that he apologize for his unethical, unsanctioned theft of Robert Kennedy's intellectual property and the intellectual property of all those whose work he has plagiarized." Miss Kerry, plagiarism is a matter of the courts to decide, in your country and mine; it is not for an American President to tell a Filipino Senator to go jump in the lake - assuming there is a lake. This is a clear case of prejudgment.

    Who's afraid of CATS? At any rate, the old and new CATS, the catty bloggers and Kerry Kennedy, are presenting worn-out arguments. They don't have any new arguments; their old arguments I have already blasted away - or reduced to logical fallacies. Why? Those who clothe themselves with the mantel of Reproductive Health are naked; those who invoke academic freedom to go against the Roman Catholic Church's strictly pro-life choice within Catholic universities are nude; and those who insist on plagiarism without proof are without clothes, much like Andersen's Emperor.     The problem is poverty, not fertility. With their noise, the CATS and other advocates of Reproductive Health are trying hard to divert our attention to the real problem towards the problem that they can solve. This is a clear case of predilection.

    In his own blog, Miguel Syjuco is pleased to announce that as "part of the peripatetic millions-strong Filipino diaspora," he now "temporarily" lives in Montreal, Canada (miguelsyjuco.com). He is a writer without a country. The problem is neither academic nor semantic; it cannot be solved by 10 million Filipinos without a country writing 10 million paperback novels each selling 10 million copies in the United States, or Canada. He resides too far away from the realities of life in these islands. If he truly loves the Philippines, my country too, he should come home and be permanently a part of the solution, not remain a part of the problem. This is a clear case of patriotism getting the better of someone.

    Meanwhile, Miguel Syjuco remains an island, entire of himself; he remains apart from the continent, apart from the main.
