    Default need advice!!! plz...


    i dont know if this is the right section for this!!

    I graduated college last October 2011 and after that I was a hired on as a software engineer.
    the company started on december 2010. and as far as i know they dont have business permit yet until now...

    i've been working there for 7 months.. bag-0 pa lng ko na regular..
    the problem is until now wla pa ko TIN or any benefits.. like SSS, Philhealth, Pagibig etc..

    ang nkasuwat gud on the contract I signed is that the benefits will be handle solely by the employee..

    Questions:
    1.) nagplanu ko na muresign but the problem is i am afraid na dli ma credit ang experience provided na dli registered ang business..
    2.) obligado ba na ang company ang mu process sa mga benefits sa employee?? if yes naa bna xah sa balaod (unza na balaod)?
    3.) nagplanu sad ko na e report ni sa DOLE pwo basin ma apektuhan ko..

    for that matter blitzen12, u can mention that company and experience that u had to ur resume if mo-apply ka pohon...as long mka-provide ka ug COE frm that company...kung nka-state sa u contract nah "the benefits will be handle solely by the employee.."..murag wala tah mhmz anah kay claro man d.i nah nka-state nah cya sa u contract b4 ka mo-sign...

    for the DOLE Report..hmmm...murag long process pah au nah, if willing to go for it, u can always consult a lawyer for that matter..hehhehee..

    TS ang contract ra gyud imo pina main weapon
    and hopefully lang wala loopholes and gray areas coz usually mao ni gi exploit sa mga abusive employers/companies
    and, also, ayaw lang ka lain ha kay ila na ipa sikot2x ug e-complicate na nila pag maau usually ang contract
    and ang tendency tawn sa mag dali maka trabaho is half taranta and half nag libog ug gibasa man gani wala pud tarunga ug sabot

    and that is usually the case

    Ipa review lang na ug tarong imo contract sa katong naay mga legal knowledge

    honestly mao jud na akong case b4 ko nisign.. nataranta and naglibog din wla tarunga ug sabot ang gibasa.. karon lng ko realize na sayup d i to.. pwo unzaon taman napermahan naman... that's why i am asking for an advice!

    gani ipa review na ug mga legal professionals esp in labor practices
    pangita ug angle wherein there's something like an intent to convolute the statements of agreement sa contract that clearly signifies the exploitation of an individual, or a would be employee like you in this case, nga mag libog tawn yet compelled to agree to sign due to somewhat dire need to work.

    Im not saying ha nga hinay ka ug pag sabot pero naa times ma mental block ta and mao take advantage pud some companies or employers nga instead nga naa unta mas direct and shorter means pag sulti sa agreement ila complicate and there maklaro nga it's somewhat trying to lead someone to get confused.

    dapat naa jud ka SSS, philhealth kay gamit kaau na. kay wala ta kahibaw sa panahon. akong suggestion nimo TS, why not ask your HR or your boss about it.

    or pangita lang ug laing company kanang legal.
