We deeply know that they aren't real women but what they are fighting for really are equality of rights -- meaning a transgender woman has the same rights with a real woman. However, prior achieving that right they need to prove that their state of mind goes well with the gender they choose -- as such they need to undergo psychological tests and complete change (name, gender, organ, hormones, etc.). Failure to prove will mean that they have gender identity disorder. So if being a transgender does not cause distress or there is contentment with the chosen gender then these are indicators of having a legal state of mind. This is the case of Jenna T. From an early age of 4, she knows that she is a female under a male's body. And to emphasize that more, she completely lived as a woman. Her gender in her licenses and passports are female, her name was changed from Walter to Page to Jenna, she has a boyfriend, and a lot more things to consider.
