    Default Need help / advise: Can i sue a company even before i work for them?


    hey guys, i need ur opinion..

    Lets just hide the company name as company ABC... i applied sa ila last march.. after taking the exam, i was told to go back for an interview. then after a week, gipa balik napud ko for another interview. Finally i was called again for the final interview, this time with the owner na.

    by the way, sa akong resume and sa mga interviews I told them i was still employed with my current employer. It was clear gyud.

    anyway, during my final interview with the owner she told me that there's another position that's vacant and she thinks i am more suitable for that position. longer working hours but the pay and commission are higher pud. so i agreed. she then asked me when i can start. i told her i will submit my RL tomorrow but since i am in sales, naa pa 2 weeks para mo turn-over sa accounts. she said why not after holy week nalang para you can take a break lang pud. so we agreed i will start on april 10, 2012. she told me to approach HR and ask for the list of requirements which i should submit when i report on my 1st day. we shook hands and she even said i'll see you on april 10.

    so i resigned.

    april 4, 7PM, i got a text message from HR.. she said "we're sorry to inform you that we are withdrawing your application. sorry for the inconvenience."

    i asked why, she said confidential daw and its management's decision. i said but i resigned from my current work bec i was offered a job in your company. she said wala daw sya ma buhat coz decision sa management. I said, you could have inform me earlier. she just said sorry for the inconvenience.

    i find it unfair and bastos and very unprofessional. some of my friends said i can sue them for damages. but i still need a lawyer to confirm this. i have all the emails and text messages as evidence.

    do you have evidence pertaining that you've already been selected by them?

    it will be a big help if you have these docs before you move into legal action

    the prob lang is that i still haven't signed any contract coz dapat by april 10 (my 1st day) paman ko mu sign. bit i do have emails and text messages from HR that would support my complain, i saved the text message HR sent in which she indicated na ila gi withdraw akng application.. naka save pud akng mga reply nako niya

    If this happened to me I will definitely sue them all, maypag ipa firing squad na sila tanan ! unsa na nga company ?

    better ask advise from a legal counsel regarding your situation TS..

    be prepared also for the long and tiring process if you pursue legal action, it might drag your career and time...

    be prepared to wait for at least 10 years for this to be resolved... We filed a case against Cebu Pacific before and perteng hinaya jud sa justice system diri sa pilipinas. They lost that case by the way.

    yeah, i just find it unfair kaayo and very unprofessional. d sad baya lalim mangita work, that's why bitaw b4 resigning you should have another job waiting for you cz its not easy na waly income

    the company is smaller man pud kaysa cebu pac, but known sya here in cebu. cebu base man ang owner...

    basin dirty moves na sa imo employer before. naa baya HRA nga organization sa cebu. its their way of sharing confidential information between companies. basin kailangan ug mag retrench inyu company pero dili sila ka paresign ninyu mao ingon ana ila gibuhat para voluntary resignation. hehhe. but if you are ingood terms sa imo company, i think pwede na nimo mahangyu and tell previous company what really happened.

    naa mi kauban sa hiring sauna. among the 25 hired, siya ray employed pa so niresign siya. later ang management nag decide na dili nalang to siya apilon sa hiring kay ma delay ang training. mao to. wala na hinuon to siya work kay niresign siya then wala pud ipadayun iya contract sa amo trabahuan. luoy kaayu
