    Then, everytime you solicit services from utilities companies for example..we need to bring a lawyer before signing up! ...even buying airline tickets. Naa man sad fine points at the back of your tickets. Bottomline, ang mangilad, mangita jud paagi mangilad! By the way, got call from Ayala Mall admin office for a pre-mediation meeting kay nakadawat pud daw sila letter from DTI...

    By the way, I suggest those who still talk about "you should have read the contract fine points before signing up, etc.....bullshit!!"...try to google "Fitness First Scam"....it is not just in the Philippines...it's everywhere! This is how FF operate their deceitful business..it's called Direct Debit SCAM!!! Try mo adto sa SM, naay daghan diha cge'g panawag ug potential clients representing something else....BEWARE! mao sad na ila SCAM!!! These companies unfortunately are run by thieves and liars! Unfortunately, taking advantage of the credit card companies direct debit facilities...... how the **** can the Credit Card Assistant Manager told me "We have to honor the contract we have with Fitness First!!!"...dumbass!! How about honoring your cardholder demand to stop payment/direct debit from Fitness First to continue sucking my account? and the cardholder is revoking the rights given to Fitness Fitness to direct debit to the account! Only then, they gave us a form to be filled-up to dispute FF debit transactions (..subject for approval). And to think, the card company assistant manager was herself a former FF member and went into the same anguish to bail out!! Next stop, Bangko Sentral ng Pilipinas to mediate! If this issue with FF will not be resolved in DTI. Anyhow, I just found out the Ayala Mall admin officer caller was the Mall's Marketing Supervisor Re: The issue with FF as per letter addressed to them by DTI...I was on a meeting with my clients when she made a call and I promised to return call. Unfortunately, it was almost 6 pm when my meeting was over so she was already not available...So I will have to personally come with my concern kin ASAP to see her and see what happen. If FF representative/s will be present during this Ayala meeting and persistently manipulative and lying, you FF liars and thieves reading this, be careful!!!

    For everyone's info. as consumers:


    1. Just because you have signed up and entered into a Contract with merchant/supplier that you are already fully bounded with the fine points. Do not let this contract keep you from exercising your rights as a consumer if the contract that you entered into was a result of deceptive, unfair and far beyond what is considered reasonable.
    2. Consumer still have the rights as per the Consumer Act of the Philippines and it provided the policy of the state on deceptive, unfair and unconscionable sales acts or practices. It is the policy of the State to promote and encourage fair, honest and equitable relations among parties in consumer transactions and protect the consumer against deceptive, unfair and unconscionable sales acts or practices.
    3. The implementing government agency on the provision of the consumer act on deceptive, unfair, and unconscionable sales acts or practices is the Department of Trade and Industry.

    • Q. What is unfair or Unconscionable sales act or practice?



    • A. An act or practice of the producer, manufacturer, seller or supplier of a consumer product or the owner or operator of a consumer service or repair firm of inducing, or enticing a consumer to enter into a sales or lease transaction of a consumer product or to avail of its services grossly inimical to his interests or grossly one-sided in favor of the producer manufacturer, distributor, supplier or seller, owner or operator, by taking advantage of the consumer's physical or mental infirmity, ignorance , illiteracy, lack of time of the general conditions of the environment or surroundings.



    • Q. What are the circumstances to be considered in determining unfair and unconscionable sales acts and practices?



    • A: The following circumstances shall be considered : That the producer, manufacturer, distributor, supplier or seller took advantage of the inability of the inability of the consumer to reasonably protect his interest because of difficulty to understand the language of an agreement or similar factors; That when the consumer transaction was entered into, the price grossly exceeded the price at which similar products or services were readily obtainable in similar transaction by like consumer; That when the consumer transaction was entered into, the consumer was unable to receive a substantial benefit from the subject of the transaction; That when the consumer transaction was entered into, the seller or supplier was aware that there was no reasonable probaility of payment of the obligation in full by the consumer; That the transaction that the seller or supplier induced the consumer to enter into was excessively one-sided in favor of the seller or supplier.


    I came to know that the one-sided contract is called "Contract of Adhesion" in legal term (?).

    ganahan ko mu enroll pero murag kuyawan ko dah...komplikado ra kaayo. dri raman gud kos amoa tag 20php per day. pero nahan ko mutesting bisag one year lang ug unsa jud ning fitness first.

    DTI Mediation between FF(defendant) and plaintiff: Settled and plaintiff's demands to be complied by the defendant. Pertinent paper works to be completed by dependant on or before end of this month.

    Cannot post details of the mediation to respect the confidentially of the proceedings.

    What I can share though is the professionalism of the DTI-Cebu especially the Consumer Welfare and Business Regulation Division (CWBRD)...I am right afterall, as long as you have valid and rightful issue, government will look after our welfare.

    To DTI-Cebu Provincial Director Nelia V.F. Navarro, I salute your leadership!

    tsk3x it happened also to me! sometime year 06 nahitabo ni nako pero nahuman gyud nako ang 6mos contract nako nya ila pako pa issuehon ug another check kay wala pud daw ko mag advice nila nga mo stop nako hehe nga ang last month nga gibayaran nako wla man gani nako sudli bisag ka usa kay ni larga kos US. now,gitawagan kos balay nga nag pahibalo nga nadaw koy bayranan nila. b.s.! ilara ang unggoy ayaw lang ang tawo kay naa nay boot!
