    Default a question for contractuals


    nagwori akong pinsan nga contractual if naa xa makuha nga 13th month pay. his contract is only good for 6 months peo magrenew sila this nov for another 6 months. he's asking me kung naa daw. waa ko kabalo kai d ko sweto sa labor code so i just wanna ask for your opinions kung naa ba..hehehe..hope you could help.

    not sure if this helps...because in this case, the employee was terminated....NOT renewed....

    The 13th Month Pay Law is Presidential Decree 851, as amended by Memorandum Order 28. In essence, it states that all employers should pay ALL (MO 2 their rank and file employees a 13th month pay, to be given on or before 24 December every year, provided that they have worked for AT LEAST ONE MONTH during the year.

    Employees Covered by 13th Month Pay Law.
    All rank-and-file employees, regardless of their designation or employment status, and irrespective of the method by which their wages are paid, who have worked at least one month during the calendar year are entitled to 13th month pay.
    mployees excluded from coverage of 13th month pay law.
    Managerial employees;
    Those covered under the civil service law;
    Those already receiving 13th month pay or its equivalent. Christmas bonus, mid-year bonus, cash bonuses and other payments amounting to not less than 1/12 of the basic salary are treated as equivalent of 13th month pay;
    Household helpers and persons in the personal service of another; and
    Those paid on purely commission, boundary, or task basis, and those who are paid fixed amount for performing specific work except those paid on a piece-rate basis.

    wa kaayo ko ka get aning contractual employment. unsa man ka under ka ug agency or direct hired ka sa company pero contract employment lang?

    naa na cya 13th month oi k good as employee rman japon na cya, casual lng. kng d cya ka abot sa dec kwentahon guro na based on how many months she/he worked for this year

    sa amo b4 naa man to.. g apil na hatag sa last pay namo pag end sa contract.. among last pay 13mos og separation fee... also tax refund...

    for sure naa gyud na 13th month pay computed based on the period worked for the year...prorated ang computation ana whether organic employee or contractual not unless fixed contract meaning lump sum payment / job order.
