    Default i need help!


    ngayo lang kog advice, kay ako cousin employed sa usa ka company na high end ang mga baligya. Almost 1 year na sya sa company pero wla gyud sya gi-regular, till nabasahan nalang nila sa sunstar na ga hire og new ang company in replacement sa iyaha. Nakapait kay wala jud moistorya ang HR, bali nigawas na gatagna2 nalang sya na ilisan siya. Nahadlok sya mao ga apply2 nalang sya para maniguro since wla syay laing source of living. Mga after 1 month, naa na silay na hire, nakig-talk ang HR niya na under observation iyang performance, and kung unsatisfactory daw, she wil b terminated. After a week sa ilang pag talk sa HR, nakigmeeting ang HR niya og balik para ingnon sya na 1 week nalang sya taman sa company ky dili maayo iyang performance.

    Ask lang syag advice kung dapat ba sya moduol sa DOLE na ana ra sya kadali gi terminate na dapat 6months pa lang gi-evaluate na iyang performance? Walay sss or philhealth.

    Ngayo lang mig advice unsay angay buhaton.

    unsa man iya contrata? nakapirma siya ug contrata?

    pwede man siya modool ug Dole magpaadvise. Pero unsa man iya gusto? magparetain sa trabaho? Ganahan pa kaha siya motrabaho sa kumpanya nga hibalo siya dili na ganahan sa iyaha? Or separation iya habol?

    nindot if sa labor department na ninyo husayon para mkita kng naa ba gyuy nlapas ang employer sa imung couzin.

    the fact that the company is not paying SSS is already illegal.
    under law Philippine labor law, after 6months and dili paka i fire, then automatic naka regular.


    ARTICLE 281. Probationary employment. – Probationary employment shall not exceed six (6) months from the date the employee started working, unless it is covered by an apprenticeship agreement stipulating a longer period. The services of an employee who has been engaged on a probationary basis may be terminated for a just cause or when he fails to qualify as a regular employee in accordance with reasonable standards made known by the employer to the employee at the time of his engagement. An employee who is allowed to work after a probationary period shall be considered a regular employee.

    ARTICLE 282. Termination by employer. – An employer may terminate an employment for any of the following causes:

    (a) Serious misconduct or willful disobedience by the employee of the lawful orders of his employer or representative in connection with his work;

    (b) Gross and habitual neglect by the employee of his duties;

    (c) Fraud or willful breach by the employee of the trust reposed in him by his employer or duly authorized representative;

    (d) Commission of a crime or offense by the employee against the person of his employer or any immediate member of his family or his duly authorized representatives; and

    (e) Other causes analogous to the foregoing.

    first of all, dili intawn ni sa politics & current events... sa career center unta ka nag post, TS...

    ana ni siya: naa pa ba ang contract sa pag hire niya? unsa naa sa contract?? if ang contract says 6 months probation, then daku ni violation sa company sa imong cousin... kung wala gi-evaluate after 6 months, meaning to say, automatic regular imong cousin, whether unsa ilang lame reasons diha... got it?

    since you mentioned wala mo bayad of SSS, philhealth, pag-ibig, it is still illegal... ang angay buhaton sa imong cousin ana is to gather all of her payslips starting from the very 1st payslip up to the last payslip she have... lisod ana if wala siya mag-file of payslips for her personal copy, unya nangawala...

    i dont know if ang company dli mohatag og payslips a labor code violation... paki-klaro kuno ko ani...

    TS post sa details sa imo contract para di ta magspeculate. Basin diay 1 year ra imo contract then end of contract jud ang paghawa sa imong cousin. Para di ta mag-assume og mag jump into conclusion.

    ang nakahasol anang muadto kag DOLE, kay usahay, two way jud cla... ngayo clag fee nimo, ngayo sad clag fee sa imong employer... ang resulta ikaw ra gyapon ang pildi... it's like david and goliath... ikaw, vs. s imong company...

    let me rephrase imong statement, nag work na cya sa company for 1 year? wa kaau ko kibaw sa law dnhi sa employment,but ang akong nahibaw an 6 months na man tingay na...
